Please ensure you fully read and understand the policy as detailed below, as the completion of your purchases can be done so only at the agreement of our Terms & Conditions, and that by agreeing to our Terms & Conditions you are bound by the following policy. At checkout you will be required to Tick the box marked "I accept the Britishfoodstoreonline.co.uk terms and conditions" should you agree to them, and by not agreeing to the following Terms & Conditions you will be unable to complete your purchase with British Food Store Online (hereby referred to as ‘BFSO’).

2 The contract between Us and You

2.1 At checkout you will be required to confirm payment method and acceptance of the T&Cs. Your credit or debit card will be charged at the checkout.

2.2 On completion of both, you will receive a confirmation email from BFSO confirming that your order is being processed.

2.3 Any order has to be accepted by us. If for any reason we are unable to complete your order we will contact you the customer via the contact details provided and issue a full refund of the unattainable goods. If we fulfil the order in its entirety we will issue a Dispatch Confirmation via email, at which stage the contract is formed.

3 LINKS

3.1 Any content contained within links of third party companies are entirely the responsibility of the provider, and not BFSO. This disclaimer does not affect your statutory rights against that third party.

4 Right of the consumer

4.1 The customer of BFSO may cancel the contract at any point within seven days of receipt of goods. The customer is entitled to a full refund as per our refunds policy (set out in Clause 8 below).

4.2 In order to cancel the contract you should inform BFSO in writing at the earliest notice. Send letter to the registered address above or via email at Customerservice@britishfoodstoreonline.co.uk. Product(s) must be returned to us as early as is reasonably possible to the business address stated above in an unused, undamaged condition. BFSO is not responsible for any costs incurred in returning goods for refund.

4.3 The customer has a legal obligation with regards to the care of Product(s) whilst within the eligible time frame for refund. Failure to comply could lead to legal action being sought, if within the eligible time frame for refund.

5. AVAILABILITY AND DELIVERY

5.1 Orders will be dispatched within 48 hours of receiving the order, unless otherwise specified by BFSO. Deliveries will be received by the customer between 5-9 working days of dispatch, although this can vary depending on destination. (Guideline delivery time for the majority of European destinations is between 4 to 8 working days of dispatch and 7 to 12 working days for non-European countries.) Weekends and Bank holidays are not classified as working days. These guidelines are estimates, not guarantees and may be subject to fluctuation by the third party nominated carrier of BFSO. It is the responsibility of the customer to notify BFSO if goods have not been received within the estimated delivery frame.

5.2 BFSO has the right to nominate any UK based carrier for shipping parcels overseas and the carriers have the right to deliver items to alternative addresses ie: next door neighbors, local GPO's (these have to be collected within 16 days). Where a product is out of stock we will dispatch a similar product of similar value.

5.3 All descriptions, product images and weights are those of the original manufacturer and are intended to give a general description of the goods. The weight to be shipped includes the weight of packaging for the goods.

5.4 Chilled items may be packaged and couriered seperately to other non-chilled perishable goods. An estimated delivery date and tracking number will be provided on dispatch. You agree that yourself or an alternative person will be available to receive the delivery of all packages, and that BFSO accepts no responsibility in the customer’s failure to ensure proper arrangements are made to receive chilled good(s).

5.5 If in the instance an order of chilled goods is delivered in an un-satisfactory condition, our courier will provide a form detailing any damage and will be required to witness you open the package and inspect it's contents. If this is the case, you should inform BFSO as soon as is possible and supply BFSO copies of all documents. If for any reason you are not supplied with documents by the courier, you should not accept any damaged consignments.

6 RISK AND TITLE

6.1 The Products will be at the customer’s own risk from being delivered.

6.2 Ownership of any purchased items will only become yours when payment for all sums (including any shipping prices) is made in full.

7 PRICE AND PAYMENT

7.1 Listed prices are inclusive of VAT. Delivery cost is not included, but will be applied to total cost of order at checkout. It is the customer’s responsibility to confirm all the details of the order are correct (including delivery address) before submitting order.

7.2 All listed prices are subject to change, but any changes implemented after a Dispatch Confirmation has been sent do not change on the order in progress.

7.3 Any product that has been priced incorrectly at a lower price than is the correct price by BFSO, BFSO will contact you before fulfilling the order or decline the order and contact you accordingly. BFSO is not obligated to honour any incorrect prices.

7.4 In the event BFSO have priced a product at an incorrect higher price, the customer will be informed within the delivery paperwork, a refund for the difference will be issued via the means payment was made.

7.5 Payment will be charged to your credit or debit card when at point of checkout.

7.6 All payments are processed in Pounds Sterling. The exchange rate is that at the stage of authorisation of your credit/debit card. BFSO accept no responsibility for adverse currency fluctuations.

7.7 Weight of items purchased are based on either ACTUAL weight of the product or VOLUMETRIC weight(whichever is the higher). Volumetric weight is based on items that are light but large in size. The size of the object takes up more room in the overall package and is therefore charged accordingly.

8 REFUND POLICY

8.1 When you return a Product to us:

8.1.1 The customer has 7 days to notify BFSO of their request for a refund (see Clause 4). The goods must be returned to BFSO within a reasonable time frame from the date of notification in re-sellable condition (see Clause 4.4). The product and delivery costs will be refunded in full on return, but the customer responsible for any costs incurred in the return of any item to BFSO.

8.1.2 In the case of a defective product, the customer will need to return the product to BFSO. BFSO hold the right to inspect the product and either send out a replacement or refund it. The product and delivery costs are returned in full on return, and the customer will be reimbursed the cost of returning the product to BFSO on submission of proof of delivery charge.

8.2 If the product is damaged in transit, the customer should submit photographic evidence of the product in its damaged condition. If BFSO is satisfied that damage to the product has occured during transit, a full refund will be issued via the means of payment made.

8.3 Refund will usually be issued via the same method of payment, unless otherwise instructed by the customer.

9 OUR LIABILITY

9.1 We guarantee any item offered and sold by BFSO are of good quality and are considered fit for purpose for which they are normally provided.

9.2 Any losses incurred by the customer by BFSO’s failure to fulfil their order are only the price of the product purchased.

9.3 We will not be held responsible for any other losses incurred.

10 IMPORT DUTY AND CUSTOMS

10.1 Any order couriered out of the UK could attract import duty or tax which are collected at the destination country. Responsibility for such charges is solely the responsibility of the customer and does not form part of the contract made between BFSO and the customer. 

10.2 Any order placed for delivery outside the UK must conform with all legislation in the destination country. BFSO are neither liable nor responsible for the breach of any laws arising from the customer’s purchase of goods through BFSO. Any goods returned to BFSO arising from any regulatory non-compliance of legislation in the country of destination there will be 100% restocking charge and should any authority destroy any items at their discretion BFSO will not be held responsible for any losses. Therefore, it is the customer’s responsibility to comply with all applicable laws and regulations of the country of which the products are destined. BFSO will not be liable for any breech by the customer of any such laws.

10.3 The bovine products sold through our store have all been produced in line with the Bovines and Bovines Products (Trade) Regulations 1999.

11 WRITTEN COMMUNICATIONS

11.1 At times, law states that some information or communications we send to you are to be in writing, We will use e-mail or provide you with information via our website. For contractual purposes, by using our site you agree to this type of communication and you accept that all such communications that we provide to you electronically comply with any law applicable that those communications be in writing. This condition does not affect your statutory rights.

12 NOTICES

12.1 All notices for requests for information by the customer should be provided in writing either to the registered address or online at Customerservice@Britishfoodstoreonline.co.uk. Any notice provided by BFSO to our customers via the website will be regarded as delivered immediately when posted on our website, and 24 hours following e-mail notification, and 3 days following postal of written letter. Notice will be issued to either the e-mail or postal address provided to BFSO by the customer when placing an order, or in any of the ways specified in clause 11 above.

13 TRANSFER OF RIGHTS AND OBLIGATIONS

13.1 A contract formed by the customer with BFSO (including your rights or obligations arising from it) may not be transferred, assigned, charged or otherwise disposed of without advance written consent of BFSO.

13.2 BFSO bear the right to transfer, re-assign, charge, sub-contract or dispose of a contract in any other way, as well as any of our rights or obligations arising from it, at any stage of the term of the contract.

14 EVENTS OUTSIDE OUR CONTROL

14.1 BFSO is will not be held responsible or liable for any failure or delay to execute a contract that may be caused by events outside of our control (Force Majeure Event).

14.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

14.2.1 Strikes, lock-outs or other industrial action;

14.2.2 Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

14.2.3 Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

14.2.4 Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

14.2.5 Impossibility of the use of public or private telecommunications networks;

14.2.6 The acts, decrees, legislation, regulations or restrictions of any government.

14.3 BFSO’s fulfilment of any contract is deemed as being suspended for the duration of the Force Majeure Event, and an extension of time will be applied for the duration of that period. BFSO will use reasonable endeavours to bring to an end the Force Majeure Event or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

15 WAIVER

15.1 If strict performance of the customer’s obligations is not enforced by BFSO in relation to this agreement, or should the rights and remedies of BFSO formed under the contract with the customer not be exercised, this will not be deemed to waive such rights or remedies and shall not relieve our customer from compliance of their obligations.

15.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.

15.3 Any waiver by us of any T&C's shall not be effective unless given to you in writing in accordance with clause 12 above.

16 SEVERABILITY

16.1 If any of the terms and conditions within this policy are deemed as invalid, unlawful or unenforceable in any way by competent or qualified authority or person, the term, condition or provision in question will be removed from the remaining terms, conditions and provisions and theese will remain valid to the fullest extent permitted by law.

17 ENTIRE AGREEMENT

17.1 We will rely on these T&C's and any content referred to in them in terms of any subject of the contract. Whilst we accept responsibility for any statement or representation made by our authorised staff, please request any variations from these terms and conditions in writing.

18 OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

18.1 The terms and conditions within this policy are subject to change at any time, and will be done so at the discretion of BFSO.

18.2 The customer shall be bound by the terms and conditions from the time an order is confirmed by the customer, unless enforceable by law or any government department. Such changes will be applied retrospectively to all orders and the customer will be informed of any changes to any policy or terms and conditions.

19 LAW AND JURISDICTION

19.1 Contracts formed between BFSO and the customers are governed by English Law. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

The British Food Store Online (hereby referred to as ‘BFSO’) is committed to integrity and professionalism in all areas of its services and therefore upholding the privacy of our customers and users under the Data Protection Act 1998 (the "Act"). 9 PURCHASE OF ALCOHOL

9.1 Alcoholic drinks can be purchased on this website. By agreeing to these terms and conditions, you confirm that if purchasing alcohol you are of at least the minimum legal age required by the governing law in the destination country for consumption of alcohol.

9.2 it is the responsibility of the customer to clarify that the purchase of and delivery of alcohol is allowed in the destination country, if a customer orders and it is found that the carrier in the destination country will not deliver the package, or the package is confiscated, we will not be held responsible for any costs incurred by the customer in the ordering and delivery of alcohol.
